Agreement to sell vs sale deed- what’s the difference?

  • Purpose

An agreement for the sale of any property is an act that says that the property will be transferred from the seller of the property to the buyer. On the contrary, a sale deed is a written agreement in which the property seller immediately transfers the title instantly.

  • Risks

The difference between a sale deed and an agreement to sell is a lot, as with a house sale agreement, the seller of the property is to remain liable for any risks until the property is transferred to the purchaser. However, once a sale deed for a house comes into effect, the risk is immediately transferred to the buyer.

  • Contract

A home purchase agreement is a legal document that mentions payment, registration, or possession, which needs to be fulfilled by both parties involved in the agreement. In contrast, a sale deed is a contract, that needs both parties to fulfill the obligations, and the ownership of the property has been transferred legally.

  • Violation

Violation or breach of an agreement for sale may lead to damage or termination of the contract. However, when you breach an apartment sale deed while buying a property in India can result in the filing of a legal complaint with a request for monetary compensation from the other party as compensation.

  • Registration

The home purchase agreement is generally signed on a non-judicial stamp paper by both parties involved in the deal. The registration requirements vary from one agreement to another and by the sale too. On the other hand, the sale deed, however, must be registered. In a sale deed, the buyer pays the stamp duty, whereas the deed includes detailed information about both parties involved in the agreement.
